EU Issues New Data Transfer Standard Contractual Clauses

On Friday, the EU's regulators published long-awaited updates to the region's Standard Contractual Clauses (SCCs).  Among other things, the SCCs are one mechanism that allows transfer of data outside the EU, including to the US, which is otherwise deemed to lack "adequate" data protection for the personal data of EU residents.  Companies with customers, suppliers, or employees in the EU should be aware of the release of the new SCCs, which will be phased in over a period not quite two years long.  Companies that rely on the old SCCs will at some point need to update their data contracts to the new clauses.  

On 4 June 2021, the Commission issued modernised standard contractual clauses under the GDPR for data transfers from controllers or processors in the EU/EEA (or otherwise subject to the GDPR) to controllers or processors established outside the EU/EEA (and not subject to the GDPR):
