According to Mr. Cicero, patent attorneys will need to be careful in applying for patents with mechanically-oriented inventions. A day after the Federal Circuit affirmed a ruling that such an invention was ineligible for patent protection, a member of the House Judiciary Committee issued a statement sharply criticizing the Federal Circuit’s decision. This decision further expands the patent ineligibility defense and now endangers mechanical and electromechanical inventions.

An October Federal Circuit decision on mechanical patents was immediately criticized by a member of the House and met with a dissent from a Federal Circuit judge that “cast thunderbolts.” Michael Cicero, with Taylor English, says patent attorneys will need to be extra careful in applying for patents for mechanically-oriented inventions.
