Atlanta partners Jeffrey R. Kuester and Michael A. Cicero further updated their chapter titled “Intellectual Property Litigation” for the 2026 Edition of Georgia Business Litigation, published on June 23 by ALM Media Properties, LLC. The chapter debuted in the 2016 Edition of this publication and underwent earlier updates for the 2017, 2018, 2020, 2022, and 2024 Editions. The 228-page chapter includes updates discussing 2023-25 decisions from Georgia federal and state courts addressing trademarks and copyrights, as well as recent U.S. Supreme Court and Eleventh Circuit decisions on those subjects.
The updates include new trademark-related text written by Mr. Cicero discussing trade dress protection and registration, the impact of a 2023 Supreme Court decision and a remanded 2025 district court decision on the parody defense to trademark infringement and dilution actions, and the impact of remanded 2024 appellate and district court decisions concerning the scope of monetary and injunctive relief in trademark cases involving accused activity occurring at least partially outside of the United States.
